She & HER, Inc. Terms of Service

1. About She & HER


She & HER is a community platform operated by She & HER, Inc., a corporation incorporated in the State of Delaware, United States (“She & HER,” “we,” “us,” or “our”). She & HER is an intentional community built specifically for sapphic women, women who love women (WLW), trans women, and non-binary people who identify with or move through the world in a sapphic way.

Our platform provides community connection, friendship, dating, and networking services exclusively for this community. Access to She & HER is application-based and subject to membership review.

2. Acceptance of Terms


By downloading, accessing, or using the She & HER mobile application or website (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Platform.

By clicking “Confirm & Continue” during onboarding, you confirm that you have read, understood, and agreed to these Terms.


3. Eligibility


3.1 Age Requirement

You must be at least 18 years of age to use She & HER. By using the Platform, you represent and warrant that you are 18 or older. We do not knowingly collect information from or provide services to anyone under 18. If we learn that a user is under 18, we will terminate their account immediately.


3.2 Community Eligibility

She & HER is a community built specifically for women — including trans women — and non-binary people who identify as women or move through the world in a sapphic or WLW way. By applying for membership, you represent that you meet this community definition.

We reserve the right to deny or revoke membership to anyone who does not meet our community criteria, at our sole discretion.


4. Application-Based Access


She & HER uses an application-based onboarding process. Submitting an application does not guarantee membership. We personally review every application and reserve the right to accept, deny, or request additional information from any applicant.

If your application is denied, you may submit an appeal to appeals@sheandher.io. Appeals are reviewed manually. Submitting an appeal does not guarantee reversal of the original decision.

We reserve the right to revoke membership at any time for violation of these Terms or our Community Guidelines.


5. User Conduct


5.1 Prohibited Conduct

You agree not to:

  • Misrepresent your identity, gender identity, or eligibility for the She & HER community
  • Harass, abuse, threaten, or intimidate other members
  • Share another member’s personal information without their consent (doxxing)
  • Post or distribute unlawful, defamatory, obscene, or harmful content
  • Use the Platform for commercial solicitation or spam without our written consent
  • Attempt to circumvent our security systems, application review, or access controls
  • Create multiple accounts or apply after having been denied or banned
  • Scrape, crawl, or extract data from the Platform by automated means
  • Impersonate She & HER, its staff, or other members


5.2 Content Standards

You are solely responsible for any content you post, upload, or transmit on the Platform. You represent that your content does not violate any third-party rights, applicable laws, or these Terms.


6. Intellectual Property


All content, trademarks, logos, and software associated with She & HER are the property of She & HER, Inc. or its licensors. You may not copy, reproduce, distribute, or create derivative works from any She & HER content without our express written permission.

By submitting content to the Platform, you grant She & HER a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely in connection with operating and improving the Platform.


7. Privacy


Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. She & HER collects and processes special category personal data including information about sexual orientation, religious beliefs, and racial/ethnic origin. By using the Platform, you consent to this processing as described in the Privacy Policy.

8. Subscription and Payments


She & HER may offer paid membership tiers. Subscription terms, pricing, and billing details will be disclosed at the time of purchase. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

We reserve the right to change our pricing with reasonable notice to existing subscribers.


9. Termination


We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms, for conduct harmful to the community, or for any other reason at our sole discretion.

You may delete your account at any time by contacting us at support@sheandher.io. Upon deletion, we will handle your personal data in accordance with our Privacy Policy and applicable law.


10. Disclaimers


THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SHE & HER DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

SHE & HER IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY MEMBER, WHETHER ONLINE OR OFFLINE. MEETING OTHER MEMBERS IN PERSON IS AT YOUR OWN RISK. PLEASE TAKE APPROPRIATE SAFETY PRECAUTIONS.


11. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHE & HER, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Note for EU/UK users: Nothing in these Terms affects your statutory rights under applicable consumer protection law.

12. Governing Law and Dispute Resolution


She & HER, Inc. is incorporated in the State of Delaware. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

For users in the European Union or United Kingdom, mandatory local consumer protection laws may provide additional rights that these Terms do not limit.

13. Changes to These Terms


We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of those changes.
